October 10 news, recently, Beijing Aiqiyi Technology Co., Ltd. and Anhui Province Blade Network Technology Co., Ltd. unfair competition dispute case first instance legal documents open.
According to the documents, iQiyi claims that Blade provides iQiyi member account rental service in the film and television area of its operation platform, and obtains high benefits from it, causing huge losses to iQiyi Company and constituting unfair competition.
Defendant Blade argued that the rights to the video account should be enjoyed by the user and that the user's account should belong to personal property. The iQiyi member accounts on the sued platform are uploaded by users, which is the proper punishment of users for personal property. The defendant also claimed in the trial that the membership system of iQiyi Company was unreasonable, resulting in the user's demand for renting or renting video accounts, and the video account leasing belonged to a reasonable business model.
After hearing, the court held that Blade Company made use of the extensive member user and non-member user base owned by iQiyi Company, and took advantage of the psychology of some users 'intention to obtain improper benefits through leasing accounts, so as to make the sued platform obtain high profits. Blade's sued behavior violated the principle of good faith and business ethics, constituting unfair competition. Finally, the court ruled that Blade Company compensated the plaintiff Aiqiyi Company for economic losses of RMB 2 million yuan and reasonable expenses of RMB 30,000 yuan.
