According to the FTC, when Disney uploaded some popular children's animations on YouTube, it did not label them as "made for kids" (this label would disable certain functions of the video, such as the collection of personal information). It is alleged that Disney did not make distinctions at the individual video level but maintained the default channel settings. If a channel is labeled "Not Made for Kids", even if the uploaded content is clips from children's movies such as "The Incredibles", "Toy Story", or "Frozen", it will be classified as "not for kids". The FTC alleges that this practice evaded YouTube's strict restrictions on children's videos, allowing the relevant videos to still trigger YouTube's autoplay function and permitting the collection of children's data and the placement of targeted advertisements, thus violating the Children's Online Privacy Protection Act (COPPA), which requires parental consent before collecting information from children under 13. In fact, as early as 2020, YouTube had informed Disney that its video labels were incorrect and changed the labels of more than 300 videos from "Not Made for Kids" to "Made for Kids". However, according to the complaint, Disney then continued to retain only the default settings at the channel level. Under the proposed settlement agreement, Disney will pay a $10 million civil penalty and must obtain parental consent before collecting data from children under 13 in accordance with the law. At the same time, Disney is also required to establish and maintain a new review mechanism to determine whether the videos uploaded to YouTube should be labeled as children's content for a period of ten years. If YouTube launches its own system to determine the age or age range of users in the future, Disney will no longer need to maintain this mechanism separately.
