Immediately, the defendant Xiong contacted the defendants Li and Huang, and the three conspired to launch the App in the mobile app market, putting a large number of infringing Korean TV dramas, Korean variety shows and other films and TV dramas online, and collecting advertising fees by planting advertisements in App and film and TV dramas. His works include the familiar Korean TV series "forced Landing of Love", "Legend of the Blue Sea", "King" and "Drewner Hotel", and 2127 episodes of Korean variety shows such as "Running Man", "Please the refrigerator", "good Voice of Korea", "King of masked Song" and other Korean variety shows. Some of these works have sold the right of online broadcasting to domestic video operators such as "Tencent Video", "iqiyi" and "Youku". Some of them have not been introduced by the relevant domestic operators. At the same time of their respective division of labor, Xiong, Li and Huang also recruited Zhang and Zhang to improve and maintain the original App.
From July 2019 to August 2020, the case involved the launch of "South Korean drama TV" App in Huawei, OPPO, Xiaomi, vivo and other mobile app markets, illegally copying 795 episodes of South Korean dramas and 2127 episodes of Korean variety shows for viewing, collecting advertising fees, totaling more than 221 million yuan.
CTOnews.com learned that the Jiangyin Court recently sentenced Xiong and other five people to commit the crime of copyright infringement. Xiong, Li, Huang, Zhang and Zhang jointly spread film and television works to the public through the information network for the purpose of making a profit without the permission of the copyright owner. The circumstances are particularly serious, and their acts have constituted the crime of copyright infringement. Xiong and other five people were sentenced to fixed-term imprisonment ranging from three years to one year and three months according to law, and the suspended sentence shall be applied. A fine ranging from 1.19 million yuan to 130000 yuan shall be imposed and all illegal gains shall be confiscated. The judgment of first instance has come into legal effect.
