According to the documents, plaintiff Zhang complained that a traffic accident occurred on Hangzhou S14 Hangchang Expressway in August 2021, and the plaintiff felt it was caused by the car automatically grabbing the steering wheel and braking, and Tesla refused to provide driving data from Tesla for many times. After that, Tesla gave a solution to transfer the 64000 yuan fully self-driving software to the new car, requiring the vehicle to be completely damaged and scrapped. Later, the vehicle was determined to be scrapped by the insurance company, but Tesla refused to transfer the software and refused to refund it. The plaintiff sued to the court, requiring the defendant to provide complete driving data of the accident and make a public apology.
This is the second time that Tesla has been sued in court after the case of "protecting the rights of Tesla on the roof". I do not know how this "war" between car companies and car owners will be resolved.
The defendant Tesla Automobile sales and Service (Hangzhou) Co., Ltd. raised an objection to the jurisdiction during the submission of the reply, believing that the case had nothing to do with Tesla Automobile sales and Service (Beijing) Co., Ltd., and that the subject was not a qualified defendant in this case, and applied to transfer the case to the relevant courts in Hangzhou for trial.
CTOnews.com learned that the Beijing Daxing District people's Court held that Tesla Automobile sales and Service (Beijing) Co., Ltd., as the seller agreed in the car ordering agreement in this case, is the qualified defendant in this case, and the court has jurisdiction over the case as the court where the defendant resides. In the end, the court rejected Tesla's objection to the jurisdiction.
