Judge Pexels found that the lawyers acted maliciously and made "conscious avoidance and false and misleading statements." Levidow and Levidow& Oberman said in a statement that their lawyers disagreed with the court's view that they "acted in bad faith":"We made a good faith mistake in not believing that a technology could completely fabricate a case." "

In the sanction order, the judge said that lawyers 'use of artificial intelligence to "provide assistance" was not "inherently improper," but that the lawyer ethics rules "imposed a check on lawyers to ensure the accuracy of their submissions. The judge also said lawyers "continued to support these false opinions" after courts and airlines challenged whether they existed.

CTOnews.com previously reported that the two men had previously acted as lawyers for a man suing the airline for personal injuries, and six cases fabricated by ChatGPT appeared in the lawsuit filed with the court. One of the lawyers, Steven Schwartz, admitted to using ChatGPT to search for similar legal precedents, saying he had never used AI to search legal literature before and didn't know its content might be false.
