CTOnews.com March 27, Ningde Times announced last August that it had sued China Chuangxin Airlines on the grounds of unfair competition. The case was adjudicated recently, and Sinovel was convicted of violating the anti-unfair competition law and had to pay 3.7 million yuan in compensation to the Ningde era.

According to the interface news report, the court held that CNAC poached the technical personnel and business backbone of Ningde time through a third party, who joined AVIC in violation of the signed competition restriction agreement, concealing the de facto labor relations with the former employees of Ningde time.

In response, Zhongchuang Xinhang said that the judgment of the first instance was made by the Ningde Intermediate people's Court, and there were problems in such aspects as unclear identification of important facts, and the company did not have the so-called act of poaching. China Innovation Airlines will appeal in accordance with the law to safeguard the rights of the company.

It is worth mentioning that the litigation between Ningde era and China New Airlines is not limited to the above-mentioned unfair competition case. Since 2021, Ningde Times has sued China New Airlines for infringement of five battery patents in court. So far, three patent lawsuits have been adjudicated in the first instance, and Ningde Times has won all cases, with a total compensation of 60.06 million yuan.

The judgments in these three patent cases were all made by the Fuzhou Intermediate people's Court. China Chuangxin Airlines previously said it would appeal the Fuzhou Intermediate people's Court's decision to the Supreme Court, and there was no need to pay reparations to the Ningde era.

As far as CTOnews.com knows, Ningde Times and China Chuangxin Airlines are both leaders in the domestic power battery industry. Last year, China Chuangxin Airlines ranked third in power battery installation in China, with a market share of 6.5% for the whole year, an increase of 0.6 percentage points over 2021. The market share of the Ningde era, which topped the list, was 48.2%, down four percentage points from the same period last year.
