Shulou( Report-- news on December 4, Chongqing No. 1 Intermediate people's Court recently issued a judgment of first instance on the case of OPPO suing Nokia Standard essential Patent royalty dispute [case number: (2021) Yu Minchu No. 1232]. Prior to this, OPPO requested Chongqing No. 1 Intermediate people's Court to determine the global FRAND rate for Nokia's standard essential patent portfolio and promised to accept the rate decided by the Chinese court.

It is reported that this is the first FRAND global fee judgment in the global patent dispute between OPPO and Nokia since July 2021. ( note: FRAND clause is fair, reasonable and non-discrimination clause, mainly used in anti-price war), but the specific series of first-instance judgments in the case has not yet been made public, and the exact verdict is not yet known.

It is reported that the plaintiffs in the case are OPPO Guangdong Mobile Communications Co., Ltd., OPPO Guangdong Mobile Communications Co., Ltd., Shenzhen Branch, OPPO (Chongqing) Intelligent Technology Co., Ltd., and the defendants are Nokia Technology (Beijing) Co., Ltd., Nokia Technology (Nokia Technologies Oy) and Nokia (Nokia Corporation).

OPPO and Nokia have launched lawsuits in a number of countries over the royalties of standard essential patents. The dispute between the two sides began in early July 2021, when Nokia filed a series of patent infringement lawsuits against OPPO in nine countries, including India, France, Germany and Britain. OPPO then launched a number of patent infringement lawsuits against Nokia in early September 2021, using 5G base station patents in China, Europe and other places.
