According to a complaint filed by the US Labor Relations Board (NLRB) on December 31, Tesla violated labor law by restricting Florida employees from discussing matters such as pay or working conditions.
The statement, signed by a regional director of NLRB in Tampa, said that Tesla violated the law at the end of last year and the beginning of this year because the company "told employees not to discuss compensation with others" and not to discuss the dismissal of another employee.
The document, obtained by the US media through the Freedom of Information Act, also shows that Tesla's management has repeatedly "told employees not to complain to higher-level executives about working conditions."
The indictment said the incidents took place in Tesla's Orlando office over the past year. Tesla and his lawyer didn't immediately respond to a request for comment.
Keira Brado (Kayla Blado), a spokeswoman for Tuyuan PexelsNLRB, said in an email that the judge would hear a debate on Florida's complaint at a hearing in February. If the parties do not reach a settlement, these charges will be prosecuted to the administrative judge.
The complaint filed by the regional director of NLRB is reviewed by the agency's judges and can be appealed to NLRB in Washington and then to a federal court. The agency has the power to order companies to reinstate laid-off employees and repay them, but usually cannot hold executives personally responsible for alleged misconduct or issue any punitive damages.
Tesla has clashed with NLRB in the past. The NLRB ruled last year that Tesla had violated labour laws several times, including firing a workers' union activist. The committee also asked Elon Elon Musk, chief executive of Tesla, to delete a tweet because he was suspected of threatening labour organizers. Tesla denies wrongdoing and is appealing the ruling in federal court.
Earlier this year, a federal judge reduced the $137 million in damages awarded by a jury in a racial discrimination case against Tesla to $15 million.
